Welcome to Growera.in, the Growera Assessment & Placement Management Platform. These Terms of Use (“Terms”) govern your access to and use of the Growera platform (“Platform”), provided by Growera (“we,” “us,” or “our”). Growera is an invite-only community-driven gateway for online assessments on a powerful cloud-based platform, secured with best-in-class proctoring, designed to meet industry standards and global demand for recruitment and placement.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform. 

1. Acceptance of Terms

By creating an account or using the Growera Platform, you confirm that you have read, understood, and agree to be bound by these Terms, including any future modifications. These Terms apply to all users of the Platform, including Candidates (Applicants) and Recruiters (Companies / HR Agencies).

2. Description of Service

Growera provides a cloud-based platform for online assessments and placement management. The Platform facilitates the process of conducting online assessments, utilizing proctoring services to ensure assessment integrity, and enables Recruiters to manage applicant data and assessment results for recruitment purposes. It serves as a gateway connecting Candidates seeking job opportunities with Recruiters offering jobs, within an invite-only community.

3. User Accounts

  • Account Creation: To access certain features of the Platform, you must create a user account. You agree to provide accurate, complete, and current information during the registration process.   
  • Account Types: We offer different account types for Candidates (Applicants) and Recruiters (Companies / HR Agencies). Your account type will determine the features and functionalities available to you.
  • Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.  

4. User Responsibilities

  • Lawful Use: You agree to use the Platform only for lawful purposes and in accordance with these Terms.
  • Candidate Responsibilities: If you are a Candidate, you agree to provide accurate and truthful information in your profile and application materials and to participate in assessments honestly and in accordance with the assessment instructions and proctoring requirements.
  • Recruiter Responsibilities: If you are a Recruiter, you agree to use the candidate data and assessment results accessed through the Platform solely for legitimate recruitment and hiring purposes and in compliance with all applicable data protection and privacy laws.
  • Prohibited Conduct: You agree not to engage in any conduct that may disrupt or interfere with the operation of the Platform, including but not limited to:
    • Uploading or transmitting viruses or other malicious code.
    • Attempting to gain unauthorized access to the Platform or other user accounts.
    • Engaging in any activity that violates the integrity of the assessment or proctoring process.
    • Using the Platform to transmit unsolicited communications or spam.
    • Infringing on the intellectual property rights of others.

5. Intellectual Property

All content and materials on the Growera Platform, including text, graphics, logos, software, and the platform’s design, are the intellectual property of Growera or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, distribute, or modify any content from the Platform without our express written permission.  

6. Prohibited Conduct

In addition to the prohibited conduct mentioned in Section 4, you are prohibited from:

  • Impersonating any person or entity.
  • Collecting or storing personal data of other users without their express consent and in compliance with applicable laws.
  • Using the Platform for any commercial purposes not expressly permitted by these Terms or a separate agreement with Growera.

7. Disclaimer of Warranties

The Growera Platform is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 

8. Limitation of Liability

To the fullest extent permitted by law, Growera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Platform or these Terms. Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount paid by you, if any, for accessing the Platform.  

9. No Refunds

As explicitly stated, Growera has a strict No Refunds policy. All fees paid for the use of the Platform and its services are non-refundable. By using the Platform, you acknowledge and agree to this No Refunds policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.  

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, at our sole discretion. Upon termination, your right to use the Platform will immediately cease.
